WARRANTY AND DISCLAIMER OF WARRANTY

Any new tool or accessory branded with the Fuji Air Tools name, and purchased or leased from TFT-PNEUMATIC, LLC or one of its authorized distributor or agents, is warranted to the original buyer against defects in materials and workmanship for a period of one (1) year from the date of the original invoice.

Under the terms of this warranty, TFT-PNEUMATIC will repair or replace any product or accessory warranted hereunder and return it (freight prepaid), provided that to TFT-PNEUMATIC´s satisfaction it is found to be defective as a result of workmanship or materials. In order to qualify for this warranty, written notice to TFT-PNEUMATIC must be given immediately upon discovery of such defect, at which time TFT-PNEUMATIC will issue an authorization to return the tool.

The defective item must be promptly returned to an authorized TFT-PNEUMATIC service center with all freight charges prepaid. This warranty is only valid on products branded Fuji Air Tools and purchased or leased from TFT-PNEUMATIC, or through its authorized distributors or agents.

This warranty is limited and TFT-PNEUMATIC shall have no obligation pursuant to this Warranty with respect to any tools or accessories which, at TFT-PNEUMATIC´s sole judgment, have been altered, damaged, misused, abused, badly operated, lost, worn, or improperly maintained.

This Warranty is null and void if the tool or accessory has been tampered with, disassembled, reassembled, serviced or modified prior to its return to TFT-PNEUMATIC by any unauthorized person, company or anyone other than a TFT-PNEUMATIC designee. The liability of TFT-PNEUMATIC hereunder shall be limited to repairing any products which are returned to TFT-PNEUMATIC under the conditions mentioned in this Warranty. In the rare case that the tool or accessory cannot be repaired, and only in the case that the Warranty is not null or void due to the reasons stated, TFT-PNEUMATIC will exchange the tool or accessory.

There is no time limit, due to the fact that TFT-PNEUMATIC is not the manufacturer, and delivering the tool or accessory will depend on the stock availability of the product. If no product is to be delivered within 3 months of the initial claim by the manufacturer, TFT-PNEUMATIC will refund the purchase.

TFT-PNEUMATIC reserves the right to sell products that have received updates or modifications of tool design at any time, without incurring any obligation for any other tool sold prior or after these changes have taken place. This Warranty voids any other Warranties, and sets forth the sole and exclusive remedy in contract, tort, strict liability or any other legal action. This Warranty is the only Warranty made by TFT-PNEUMATIC with respect to the products sold by the manufacturer Fuji Air Tools. TFT-PNEUMATIC shall not be liable for any consequential, special, incidental, or any other damages, including, but without limitation to, loss of profit and production delays, whether TFT-PNEUMATIC has been advised or not of the possibility of such loss. This includes liability that may arise from third parties claims against the buyer. Before operating any product supplied by TFT-PNEUMATIC, you must read all operating and safety instructions carefully.

The safe operation of these products is the sole responsibility of the user. The manufacturer, distributor, retailer, and sales agent, except where modified by law, shall not be liable for any event or condition (including any accident, death, or other event) occurring as a consequence of using or misusing said products. Tools and accessories are only to be used by professionally trained individuals (at buyers' cost and responsibility).

TFT-PNEUMATIC shall not be liable for any incidents, accidents, death or other event in which any of its products are involved. Goggles, safety footwear, gloves, and other safety paraphernalia should be used when operating said machines at all times.
